ImportantSEC's Crypto Assets Rule Proposal Concludes Public Comment Period, Receives Approximately 140 Submissions

The U.S. SEC will close the public comment period for the "Regulation Crypto Assets" rule proposal on Tuesday. First introduced in August, the proposal garnered around 140 comments during its 60-day consultation window, 6 of which were submitted anonymously. Submissions primarily focus on two core areas: first, a safe harbor provision that would prevent token issuers from being classified as parties to an "investment contract"; second, exemptions for issuances below a specified monetary threshold. The MiCA Crypto Alliance broadly supports revisions to disclosure requirements, and recommends that the SEC further define concepts and data structures unique to crypto assets. Anthony Scaramucci, founder of SkyBridge Capital, has expressed support for these rules.
